Although the chief judge was positive, the hearing was not adjourned, and on September 23, the hearings continued with the temporary assignment of Yıldıray Kaya, a member of the court. Yıldıray, who was the temporary chief judge at the 5th hearing which started on October 18, stated that Bahtiyar could not attend the hearings for a month or two due to his sicken.

Yıldıray, who was temporarily assigned to the Ankara 22nd High Criminal Court by the decision of the HSK on November 4, was appointed as the chief judge. Murat Dönmez, who is a member of the Ankara 23rd High Criminal Court, which is the decision authority of the objections made against the 22nd High Criminal Court, was appointed to replace the member of the court whose place was empty by the same decision.
